AGB / Terms of Service

1. Scope

These terms apply to all services of Ali Mert Özdemir ("EnergyLens"). Services are offered only to entrepreneurs within the meaning of §14 BGB, legal entities under public law and professional property owners (B2B). Deviating terms of the client do not apply.

2. Services

EnergyLens provides automated desk-based screenings based on data supplied by the client and public reference values. The service does not include an on-site visit, a legally required certificate, a statutory inspection or individual legal, tax, valuation or investment advice.

3. Client data

The client is responsible for the completeness and accuracy of the data supplied (bills, meter data, areas, building details) and for having the right to pass it on. Results depend on this data. EnergyLens treats client data confidentially.

4. Delivery

Delivery periods start once complete data has been received. The report is delivered electronically as a PDF with a data pack. One revision round is included. The client may use the report internally and share it with its advisers. Portal access runs for 90 days after delivery; delivered PDFs remain with the client. Subscriptions run for 12 months and renew yearly unless cancelled with one month's notice.

5. Prices and payment

The prices shown on the pricing page apply. Invoices are payable within 14 days without deduction.

6. Liability

EnergyLens is liable without limitation for intent and gross negligence and for injury to life, body or health. For slight negligence, EnergyLens is liable only for breach of an essential contractual obligation (an obligation whose fulfilment makes proper performance possible and on which the client may regularly rely), limited to the typical, foreseeable damage. Liability under the Product Liability Act remains unaffected. Otherwise liability is excluded.

7. Applicable law and jurisdiction

German law applies, excluding the UN Convention on Contracts for the International Sale of Goods. Place of jurisdiction for merchants is Berlin.
